Qori Temple di Melanie Gordillo, a sole proprietorship registered with the Commercial Registry of the Canton of Ticino, Switzerland, under identification number CHE-378.907.577, with its registered office at Via Vira 5, 6948 Porza, Switzerland (hereinafter "Qori Temple," "we," "us," or "our"), acts as the data controller responsible for the processing of personal data collected through the website https://qoritemple.com and in connection with the services, products, and digital content offered therethrough.
Qori Temple is committed to protecting the privacy and fundamental rights of all individuals whose personal data it processes. The present Privacy Policy explains in detail what personal data we collect, the purposes for which we process it, the legal bases upon which such processing relies, how your data is stored and secured, and how you may exercise your rights as a data subject. We encourage you to read this document carefully and in its entirety.

As of the effective date of this Policy, Qori Temple has not designated a representative in the European Union pursuant to Article 27 of the GDPR, as it considers that its processing activities fall within the exemption provided under Article 27(2) of the Regulation, having regard to the nature, scope, and purposes of the processing carried out. Should circumstances change such that designation becomes necessary, this Policy shall be updated to include the contact details of the appointed representative.
2. LEGAL FRAMEWORK
The processing of personal data by Qori Temple is governed primarily by the Swiss Federal Act on Data Protection of 25 September 2020 (FADP/nDSG), which entered into force on 1 September 2023, together with its implementing ordinances, including the Ordinance on Data Protection (OPDo/DPO). The revised FADP incorporates the principles of "Privacy by Design" and "Privacy by Default," and mandates transparency, purpose limitation, data minimisation, and accountability in all data processing activities.
Where Qori Temple processes personal data of individuals located within the European Economic Area (EEA), the applicable provisions of the General Data Protection Regulation (EU) 2016/679 ("GDPR") are observed in addition to Swiss law. In such cases, references in this Policy to data subject rights and processing principles shall be interpreted in a manner consistent with GDPR requirements.
3. CATEGORIES OF PERSONAL DATA COLLECTED
Qori Temple may collect and process the following categories of personal data, depending on how you interact with our website and services:
3.1 Data provided directly by the User. When you create an account, make a purchase, submit an enquiry through the contact form, register for a programme, or otherwise communicate with us, you may provide your name, email address, postal address, telephone number, payment and billing information, and any additional information you choose to include in your correspondence or during a coaching or healing session.
3.2 Data collected automatically. When you visit the website, certain technical data may be collected automatically by the hosting infrastructure, including your Internet Protocol (IP) address, browser type and version, operating system, referring URL, pages visited, date and time of access, and session duration. It is noted that, as of the effective date of this Policy, Qori Temple does not deploy any third-party analytics tools, tracking pixels, or similar technologies (such as Google Analytics or Facebook Pixels) on the website. Should this change in the future, this Privacy Policy will be updated accordingly prior to the implementation of any such tools.
3.3 Data related to purchases and transactions. When you complete a purchase, your payment data (including credit or debit card details) is processed by the third-party payment service provider integrated into the website. Qori Temple does not store full payment card numbers on its own servers; such data is handled exclusively by the payment processor in accordance with its own privacy and security policies.
3.4 Data shared during sessions. In the context of one-to-one consultations, coaching sessions, or energy work, you may voluntarily disclose personal information of a sensitive nature, including information relating to your health, emotional wellbeing, spiritual beliefs, or personal circumstances. Such data is processed exclusively for the purpose of providing the requested service, and its confidentiality is maintained in accordance with the provisions set out in our Terms and Conditions.
4. PURPOSES AND LEGAL BASES FOR PROCESSING
Qori Temple processes your personal data for the following purposes and on the following legal grounds:
4.1 Performance of a contract. Personal data is processed as necessary for the performance of a contract to which you are a party, or in order to take steps at your request prior to entering into a contract. Processing under this basis includes the creation and management of your user account, the fulfilment and delivery of digital products, the provision of coaching, consulting, and healing services, the processing of payments and invoicing, and the administration of programme enrolments and retreat bookings.
4.2 Legitimate interests. Where processing is necessary for the purposes of legitimate interests pursued by Qori Temple, and where such interests are not overridden by your fundamental rights and freedoms, data may be processed for the improvement and optimisation of the website and its functionality, the prevention and detection of fraud or unauthorised access, the management of internal administrative and organisational processes, and the enforcement of our Terms and Conditions.
4.3 Consent and Marketing Communications. Where required by applicable law, Qori Temple will obtain your express, freely given, and informed consent before processing your personal data for purposes not otherwise covered by a separate legal basis.
With respect to marketing communications, newsletters, and promotional content, the following provisions apply:
(a) Existing customers and users of digital content. Where you purchase a product or service through the website, or where you create an account and obtain access to free digital content (such as complimentary meditations, downloadable resources, or trial materials) as part of Qori Temple's range of offerings, your email address may be used to send you marketing communications relating to similar products or services offered by Qori Temple, without the need for separate opt-in consent. Such use is carried out in reliance upon: (i) the exception for existing customer relationships set forth in Article 3(1)(o) of the Swiss Federal Act against Unfair Competition (UCA/UWG), which permits the sending of marketing communications to recipients whose contact information was obtained in the course of a sale, provided that the recipient was given the opportunity to object at the time of collection and that the communications relate to similar products or services; and (ii) to the extent applicable to Users located within the European Economic Area, the "soft opt-in" exception under Article 13(2) of Directive 2002/58/EC (the ePrivacy Directive), as interpreted by the Court of Justice of the European Union in its judgment of 13 November 2025 in Case C-654/23 (Inteligo Media SA v. ANSPDCP), which confirmed that the provision of a service, including access to free content within a broader commercial strategy, may constitute a "sale" for the purposes of that exception. At the point of purchase or account creation, you will be clearly informed that your email address may be used for marketing purposes and will be given a simple, clearly disclosed, and free-of-charge opportunity to object to such use. Each subsequent marketing communication will contain an unsubscribe mechanism enabling you to opt out at any time, easily and without cost.
(b) Contact form enquiries and other non-transactional interactions. Where you submit an enquiry through the contact form or otherwise communicate with Qori Temple outside the context of a purchase or account creation, your email address shall not be used for marketing purposes unless you have provided your express consent to receive such communications. Consent in this context may be obtained by means of a dedicated, unchecked opt-in tick box presented on the contact form, enabling you to indicate your voluntary agreement to receive marketing communications from Qori Temple.
(c) Withdrawal of consent and right to object. You may withdraw your consent to marketing communications, or exercise your right to object to the use of your email address for marketing purposes, at any time and without affecting the lawfulness of any processing or communication carried out prior to such withdrawal. Withdrawal may be effected by writing to info@qoritemple.com, by using the unsubscribe mechanism provided in any marketing communication, or by adjusting your communication preferences within your account settings where available. Upon receipt of a valid withdrawal or objection, Qori Temple shall cease sending marketing communications to you without undue delay.
4.4 Compliance with legal obligations. Personal data may be processed where necessary to comply with a legal obligation to which Qori Temple is subject, including obligations under Swiss tax law, accounting regulations, and any orders issued by competent judicial or administrative authorities.
5. COOKIES AND TRACKING TECHNOLOGIES
As of the effective date of this Policy, the website does not use third-party tracking cookies, analytics pixels, or profiling technologies. Essential cookies, strictly necessary for the operation of the website (such as session cookies required for account authentication and secure navigation), may be used and do not require your prior consent under the FADP. Should Qori Temple introduce non-essential cookies or tracking technologies in the future, prior notice will be given through an updated Privacy Policy and, where required, through a cookie consent mechanism compliant with the FADP and, where applicable, the GDPR. You are free to configure your browser settings to refuse or delete cookies at any time; however, disabling essential cookies may impair the functionality of certain areas of the website.
6. DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES
Qori Temple does not sell, rent, lease, or trade your personal data to third parties for marketing or commercial purposes. Personal data may, however, be disclosed to the following categories of recipients where necessary:
6.1 Service providers. Qori Temple engages certain third-party service providers to support the operation of the website and the delivery of its services, including web hosting providers, payment processors, email service providers, and, where applicable, course platform operators. Each such provider processes data solely on behalf of and pursuant to the instructions of Qori Temple, and is contractually bound to maintain adequate technical and organisational measures to protect personal data.
6.2 Legal and regulatory authorities. Personal data may be disclosed to competent judicial, administrative, or law enforcement authorities where such disclosure is required or permitted by applicable Swiss or foreign law, or where necessary for the establishment, exercise, or defence of legal claims.
6.3 Professional advisors. Data may be shared with external legal, financial, or accounting advisors in the context of the administration of Qori Temple's business, subject to appropriate confidentiality obligations.
Under no circumstances will sensitive data disclosed during private sessions be shared with third parties absent your explicit written consent, except where disclosure is mandated by law.
7. INTERNATIONAL TRANSFERS OF PERSONAL DATA
Given the worldwide scope of Qori Temple's operations, personal data may be transferred to, and processed in, countries outside of Switzerland or the EEA. Any such transfer shall be carried out in compliance with Articles 16 and 17 of the FADP, and, where applicable, Chapter V of the GDPR. Personal data will only be transferred to countries for which the Swiss Federal Council or the European Commission has recognised an adequate level of data protection, or, in the absence of such a determination, on the basis of appropriate safeguards, including the Standard Contractual Clauses adopted by the European Commission, or any other mechanism recognised under applicable law.
8. DATA RETENTION
Qori Temple retains personal data only for as long as is necessary to fulfil the purposes for which it was collected, or as required by applicable law. The following general retention criteria apply:
Account data and purchase records are retained for the duration of the contractual relationship and, thereafter, for a period consistent with applicable Swiss statutory limitation periods and tax record-keeping obligations, which is ordinarily ten (10) years from the end of the relevant fiscal year. Contact form enquiries and correspondence are retained for as long as necessary to address the enquiry and, subsequently, for a reasonable period to manage any follow-up or dispute that may arise. Marketing and communication preferences are retained until you withdraw your consent or request the deletion of your data. Technical server log data is retained for a limited period, not exceeding twelve (12) months, unless a longer retention period is justified for security or legal reasons.
Upon expiry of the applicable retention period, personal data shall be securely deleted or anonymised so that it can no longer be attributed to an identifiable individual.
9. DATA SECURITY
Qori Temple implements appropriate technical and organisational measures to protect personal data against unauthorised access, accidental or unlawful destruction, loss, alteration, and disclosure, in accordance with Articles 8 and 9 of the FADP and the Ordinance on Data Protection. These measures include, as applicable, encrypted data transmission (SSL/TLS), access controls and authentication mechanisms, regular review of security practices, and secure storage of data on servers maintained by reputable hosting providers. While Qori Temple takes all reasonable precautions, no method of electronic transmission or storage is entirely secure, and absolute security cannot be guaranteed.
10. YOUR RIGHTS AS A DATA SUBJECT
Under the FADP and, where applicable, the GDPR, you are entitled to the following rights with respect to your personal data:
10.1 Right of access. You have the right to obtain confirmation as to whether personal data concerning you is being processed and, if so, to access such data and receive information about the purposes of processing, the categories of data concerned, the recipients or categories of recipients to whom the data has been or will be disclosed, and the envisaged retention period.
10.2 Right to rectification. You have the right to request the correction of inaccurate personal data and the completion of incomplete data without undue delay.
10.3 Right to erasure. You may request the deletion of your personal data where it is no longer necessary for the purposes for which it was collected, where you have withdrawn your consent and no other legal ground for processing exists, or where the data has been unlawfully processed. Qori Temple may decline a deletion request where retention is required for compliance with a legal obligation or for the establishment, exercise, or defence of legal claims.
10.4 Right to restriction of processing. In certain circumstances, you have the right to request that the processing of your personal data be restricted, including where the accuracy of the data is contested, where the processing is unlawful but you oppose erasure, or where Qori Temple no longer requires the data but you need it for legal claims.
10.5 Right to data portability. Where processing is based on your consent or on a contract, and is carried out by automated means, you have the right to receive your personal data in a structured, commonly used, and machine-readable format, and to transmit that data to another controller without hindrance.
10.6 Right to object. You may object at any time to the processing of your personal data for direct marketing purposes. Where processing is based on legitimate interests, you may also object on grounds relating to your particular situation, and Qori Temple will cease processing unless it demonstrates compelling legitimate grounds that override your interests, rights, and freedoms.
10.7 Right to withdraw consent. Where processing is based on consent, you have the right to withdraw such consent at any time, without affecting the lawfulness of processing carried out prior to the withdrawal.
To exercise any of these rights, you may submit a written request to info@qoritemple.com. Qori Temple will respond to your request within thirty (30) calendar days and may request verification of your identity before acting upon such request.
11. RIGHT TO LODGE A COMPLAINT
If you believe that the processing of your personal data by Qori Temple infringes the FADP, you are entitled to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC). Information about the FDPIC, including contact details, is available at https://www.edoeb.admin.ch. Individuals located within the European Economic Area who believe that their rights under the GDPR have been infringed may lodge a complaint with the competent supervisory authority of their member state of habitual residence, place of work, or place of the alleged infringement. These remedies do not preclude any other administrative or judicial remedy available under applicable law.
12. CHILDREN'S PRIVACY
The website and the services offered by Qori Temple are designed for a general audience; however, the purchase of products and services, the creation of user accounts, and the active participation in programmes, courses, and community features by individuals under the age of eighteen (18) require the prior, verifiable consent of a parent or legal guardian, as set forth in Section 1 of the Terms and Conditions.
Qori Temple does not knowingly collect or process personal data from individuals under the age of eighteen without the express consent of a parent or legal guardian. Where a minor accesses the website or utilises its services with the requisite parental or guardian consent, the personal data of such minor shall be processed in accordance with the provisions of this Privacy Policy and subject to the same safeguards applicable to all Users. The consenting parent or legal guardian is responsible for supervising the minor's interaction with the website and for ensuring that any personal data provided by or on behalf of the minor is accurate and necessary for the requested service.
Should Qori Temple become aware that personal data has been collected from an individual under the age of eighteen in the absence of verifiable parental or guardian consent, such data shall be deleted without undue delay, and any associated account or transaction may be suspended or voided in accordance with the Terms and Conditions. Parents or guardians who believe that their child has provided personal data to Qori Temple without the requisite consent, or who wish to review, correct, or request the deletion of their child's personal data, are invited to contact us at info@qoritemple.com so that appropriate measures may be taken promptly.
13. LINKS TO THIRD-PARTY WEBSITES
The website may contain links to external websites operated by third parties. Qori Temple has no control over, and assumes no responsibility for, the privacy practices or content of such websites. The inclusion of a link does not imply any endorsement or affiliation. You are advised to review the privacy policy of each third-party website you visit. Qori Temple shall not be held liable for any loss or damage arising from your interaction with third-party sites accessed through links on our website.
14. AMENDMENTS TO THIS PRIVACY POLICY
Qori Temple reserves the right to modify or update this Privacy Policy at any time to reflect changes in its data processing practices, applicable legislation, or regulatory guidance. Where material changes are made, Qori Temple will post the updated Policy on the website and, where feasible, will notify you by email or through a prominent notice on the website prior to the changes taking effect. The "Effective Date" indicated at the top of the document will be amended to reflect the date of the most recent revision. Your continued use of the website following the publication of any amendments constitutes your acceptance of the updated Privacy Policy.
